Fifth Juror Picked Today for Komisarjevsky Trial

Two men and three women have been chosen to decide the fate of the Cheshire triple-murder defendant.

Lawyers picked the fifth juror for the trial of Joshua Komisarjevsky during Thursday afternoon’s session of jury selection in New Haven Superior Court.

The juror is a 30-year-old woman from New Haven, according to a source knowledgeable about the proceedings.

She is the third woman chosen for the jury, which will decide the fate of the second defendant in the Cheshire home invasion case.

Komisarjevsky could receive the death penalty for his role in triple murder of Jennifer Hawke-Petit and her two daughters in 2007.

His co-defendant, Steven Hayes, was found guilty in a separate trial in 2010 and is on death row.

The other jurors are a male doctor who works for the Yale School of Medicine, a male college student from New Haven, a woman who works as a social work investigator for the state and a woman physician from Madison who was chosen on Monday.

Earlier today, Judge Jon C. Blue denied a motion by the defense to reconsider the judge’s ruling on April 1 to release witness lists for the Komisarjevsky trial.

Judge Blue extended his stay of the order until the April 14, when the witness lists will be released, according to court documents, unless the defense can get another judge to intervene.

The defense lawyers say releasing the names of witnesses they might call for the penalty phase of the trial jeopardizes Komisarjevsky’s right to a fair trial.
